These Terms of Service ("Terms") govern your use of the website botjockie.com and all development, consultation, and support services provided under the brand name "BotJockie" by Bhavin Chandulal Javia, a sole proprietor based in Bengaluru, Karnataka, India (referred to as "we", "us", "BotJockie"). By engaging our services or using our website, you ("Client", "you") agree to these Terms.
BotJockie offers custom software development services including, but not limited to:
Every engagement is governed by a mutually agreed project scope document ("Scope") issued before work begins. The Scope defines deliverables, timelines, and pricing for that engagement and forms part of these Terms.
BotJockie is not a SEBI-registered investment adviser or research analyst. We do not provide trading advice, recommendations, signals, or portfolio management services. We build custom software that automates a client's own trading rules, based entirely on the specifications the client provides — we do not tell you what, when, or whether to trade.
Trading involves substantial risk of loss and is not suitable for every investor. Any backtest results shown or delivered as part of our services reflect historical, simulated performance only and do not indicate or guarantee future performance.
You confirm that you understand the risks of trading financial markets (including total loss of capital) and that you are legally permitted to trade the instruments and markets you intend to automate. You accept full responsibility for all trades executed by any software we develop for you.
A project is formally engaged when (a) the Scope is agreed in writing (email is sufficient), and (b) the agreed deposit or full payment is received. We begin development only after both conditions are met.
All prices are quoted in Indian Rupees (INR) unless otherwise agreed. International clients may be quoted in USD by mutual agreement. Applicable taxes (including GST where relevant) will be added to all invoices.
Unless otherwise specified in the Scope, payment terms are:
For smaller engagements (under ₹25,000), full payment may be required upfront.
Refunds are available under the following specific conditions:
To request a refund under the pre-v1.0 conditions, email contact us with your project reference. Approved refunds are processed within 14 business days.
Each project includes a reasonable number of revision rounds, specified in the Scope. A "revision" means a change or refinement to code we have delivered against the agreed specification.
Requests that introduce new features, logic, or integrations not in the original Scope are treated as scope changes and quoted separately before implementation.
All projects include 30 days of post-delivery support from the date of final delivery, covering:
Support does not cover: new features, strategy optimisation based on live results, adaptation to new market conditions, or fixes required because of changes to TradingView, brokers, or third-party platforms after delivery. These are available under separate retainer or hourly engagements.
After the 30-day window, ongoing support is available via retainer packages or hourly billing at our then-current rates.
Upon receipt of full payment, the Client is granted a perpetual, non-exclusive, non-transferable licence to use the delivered code for personal use, including running it on their own TradingView account(s) and trading their own capital with it.
Unless otherwise agreed in writing, the Client may not:
Commercial resale or redistribution rights can be negotiated as a separate licensing agreement.
BotJockie retains all rights to its underlying methodologies, generic components, reusable libraries, frameworks, code patterns, and professional know-how developed in the course of this or any other engagement. The Client's licence does not restrict our ability to use these in future projects for other clients.
Any Pine Script libraries, templates, or frameworks that pre-existed the engagement or are part of BotJockie's standard toolkit remain our sole property and are provided to the Client under the same usage licence as the main deliverable.
We treat your trading strategy, rules, and any proprietary logic you share with us as confidential. We will not share, publish, or reuse specific client strategies with any third party without express written consent. Generic techniques, patterns, and non-identifying learnings do not fall under this confidentiality obligation.
Similarly, the Client agrees to keep all source code, internal methods, and commercial terms of the engagement confidential, except as required for personal use of the deliverable.
To the maximum extent permitted under Indian law:
We warrant that our code will function substantially in accordance with the agreed Scope at the time of delivery. We do not warrant:
All other warranties, express or implied, are disclaimed to the fullest extent permitted by law.
Either party may terminate an engagement for material breach that remains uncured after 7 days' written notice. Upon termination, the Client is liable for all work completed up to the termination date, and the refund provisions of Section 4 apply.
These Terms are governed by the laws of India. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.
Before initiating any formal dispute, both parties agree to attempt resolution in good faith via direct written communication for at least 30 days.
We may update these Terms from time to time. Existing engagements are governed by the Terms in effect at the time of engagement. New engagements will be governed by the current Terms on the website at time of engagement.
